Terms of Trade
Defined Terms
DFM Beanies ("we", "our", or "DFM") means the company owned and operated by its owner and founder and includes its successors and assigns.
Customer means the person or entity purchasing products from DFM Beanies via our website.
Products means all goods, including beanies and related accessories, supplied by DFM Beanies.
Price means the amount payable by the Customer for the Products, as shown on our website or otherwise agreed in writing.
Acceptance of Terms
By placing an order with DFM Beanies, the Customer agrees to these Terms of Trade in full. A binding contract is formed upon receipt of an order confirmation email from DFM Beanies.
Payment Terms
- All Products must be paid for in full at the time of ordering.
- Payment is accepted via credit/debit card, PayPal, or other online payment methods approved by DFM Beanies.
- All prices include GST unless otherwise stated.
Delivery and Risk
- Products are shipped upon receipt of full payment.
- Risk in the Products passes to the Customer at the point of delivery by the courier or postal carrier.
- Delivery timeframes are estimates provided by our courier partners and are not guaranteed. DFM Beanies is not liable for delays once Products have been dispatched.
Ownership and Title
- Ownership of Products remains with DFM Beanies until full payment is received.
Returns and Refunds
- If a Product is faulty or not as described, the Customer may request a return within a reasonable timeframe of delivery.
- DFM Beanies complies with the Consumer Guarantees Act 1993 in respect of all remedies for faulty or misdescribed goods.
- Products must be unused, in original packaging, and accompanied by proof of purchase.
- Change-of-mind returns are not accepted.
Warranties
- DFM Beanies complies with the Consumer Guarantees Act 1993.
- We do not warrant Products beyond those guarantees required by law.
Limitation of Liability
- DFM Beanies is not liable for any indirect or consequential losses.
- Maximum liability is limited to the Price paid for the Product.
Privacy
- Personal information is collected for the purposes of order fulfilment, customer communication, and marketing (where consent has been given).
- Customer data may be processed by third-party tools including email marketing platforms, solely for the purposes stated above.
- Customer data will not be sold to third parties.
- Customers may request to view, correct, or delete their personal data held by DFM Beanies in accordance with the Privacy Act 2020 (NZ).
- Marketing emails include an unsubscribe option. Customers may opt out at any time.
Cancellation
- Customers may cancel an order before it has been shipped and receive a full refund.
- Orders cannot be cancelled after Products have been shipped.
- DFM Beanies may cancel an order at its discretion and refund the full amount.
Governing Law
These Terms are governed by New Zealand law. Any disputes will be handled under New Zealand jurisdiction.
